Aportes de la psicología jurídica al tratamiento institucional de menores de edad en conflicto con la ley penal / Contributions of psychology to legal institutional treatment of minors in conflict with the law criminal

El presente trabajo, se relaciona con la investigación UBACYT denominada "Estudio de la práctica de la Psicología Jurídica con relación a los jóvenes en conflicto con la ley penal judicializados. Perspectiva institucional-organizacional, simbólico-imaginaria e histórico-antropológica" (20020130100842BA). La historia de las instituciones que alojan a adolescentes transgresores a la ley penal, patentiza la confluencia de innúmeras variables que determinan tanto la conducta de dichos jóvenes como el tratamiento que se les ha brindado en los distintos momentos históricos. La doctrina de la infancia regula ha quedado atrás en razón de la novada legislación existente a nivel internacional y consecuentemente la adecuación de las normativas nacionales a las modernas teorías sobre DDHH que marcan el pasaje hacia lo que hoy se denomina" doctrina de la protección integral".

This work is related to the research UBACYT called "Study of Legal Psychology practice with regard to youth in conflict with the law prosecuted. Institutional-organizational, symbolic and imaginary and historical-anthropological" (20020130100842BA) perspective. The history of the institutions that house the criminal law transgressors adolescents shows the confluence of countless variables that determine both the behavior of these young people as the treatment that has been given them in different historical moments. The doctrine of childhood regulates has been left behind because of the new legislation existing at the international level and consequently the adaptation of national regulations to modern theories on human rights that mark the passage to what today is called "doctrine of integral protection".

Una mirada histórica psicosocial sobre las instituciones que asisten a jóvenes en conflicto con la ley penal / A historical perspective on psychological institutions assisting young people in conflict with the law

El presente trabajo, se relaciona con la investigación UBACYT denominada "Estudio de la práctica de la Psicología Jurídica con relación a los jóvenes en conflicto con la ley penal judicializados. Perspectiva institucional-organizacional, simbólico-imaginaria e histórico-antropológica" (20020130100842BA). El conocimiento en profundidad de las instituciones dedicadas a la atención de jóvenes en conflicto con la ley penal, es necesario para poder vislumbrar la función psicosocial que las mismas cumplen de modo efectivo; y así favorecer una participación efectiva de través de la intervención institucional que, favorezca el desarrollo de políticas de prevención, y asistencia que redunden en una mejor calidad de vida.

The present work concerns the research UBACYT called "Study of Legal Psychology practice regarding youth in conflicts with the law prosecuted. Institutional - organizational, symbolic and imaginary, historical and anthropological" (20020130100842BA) perspective. In-depth knowledge of the institutions devoted to the care of juveniles in conflicts with the law, is necessary in order to glimpse the psychosocial function that they meet effectively; and thus promote effective participation through institutional intervention that favors the development of prevention policies, and assistance that result in a better quality of life.

Nuevas modalidades de acoso: el acoso virtual en el ámbito educativo / New modalities of harassment: the virtual harassment in the educational area

El acoso psicológico en tanto modalidad de hostigamiento, no se limita exclusivamente al ámbito laboral u hogareño en tanto hecho de violencia psíquica ejercida deliberadamente hacia un sujeto en su presencia y con la intención manifiesta o no de socavar su integridad psíquica en pos de la obtención de algún beneficio en lo material o inmaterial para quien lo ejerce. Puede también comprender ámbitos como el educativo y viabilizarse por intermedio de lo virtual, facilitado por la ampliación en la utilización de las nuevas tecnologías en el aula. Surge la pregunta, desde la psicología, acerca de los límites conceptuales de la figura del hostigamiento u acoso cuando quien lo ejerce no es un sujeto plenamente conciente del alcance de sus actos ni de aquello que genera en la víctima, debido a que algunas de sus facultades mentales se encuentran socavadas como consecuencia de un cuadro psicótico presente.

The psychological harassment while modality of harassment, it does not limit itself exclusively to the labour or domestic area while fact of psychic violence exercised deliberately towards a subject in his presence and with the manifest intention or not of undermining his psychic integrity in pursuit of the obtaining of any benefit in the material or immaterial thing for the one who exercises it. It can include also áreas as the educational one and viabilizarse through the virtual thing, facilitated by the extension of the utilization of the new technologies in the classroom. On the other hand the question arises, from the psychology, brings over from the limits to the figure of the harassment or I harass when the one who exercises it it´s a subject fullly conciente neither of the scope of his acts nor of that one that it generates in the victim, due to the fact that some of his mental powers are undermined to consequences of a psychotic present sindrome.
